These Terms govern your use of devseguro.com and any services provided by DevSeguro ("DevSeguro," "we," "us"). By using the site or engaging our services, you agree to these Terms.
1. Services
DevSeguro provides web development, cybersecurity assessment and testing, and ongoing maintenance/protection services, as described on our Web Development, Cybersecurity, and Pricing pages. Specific project scope, deliverables, price, and timeline are confirmed in a separate written proposal or statement of work (SOW) before work begins — the pricing shown on the website is a starting reference, not a binding quote.
2. Authorization for security testing
- For any Security Check, Security Assessment, Web App Security Assessment, or Penetration Testing engagement, you confirm that you are the owner of the target system(s), or have documented, written authorization from the owner to commission testing.
- Before any testing involving active exploitation begins, both parties will agree in writing to a defined scope, testing window, and rules of engagement.
- You agree to indemnify DevSeguro against claims arising from your failure to obtain proper authorization for testing you commission.
- Security testing identifies vulnerabilities present and discoverable at the time of testing using the agreed methodology and scope — it does not guarantee the absence of all vulnerabilities, nor protection against future or unknown threats.
3. Payment terms
- Deposit: 40% of the project fee is due before work begins.
- Milestones: the remaining balance is invoiced in milestone payments agreed in your proposal.
- Payment method: bank transfer.
- Late payment: invoices are due within 7 days of issue unless your proposal says otherwise. Work may be paused if an invoice remains unpaid after that date, and we may charge a reasonable late fee, disclosed on the invoice, on balances more than 14 days overdue.
- Refunds: the deposit covers planning and the work started, and is non-refundable once work has begun. If we cannot deliver a milestone as agreed in the proposal, you are entitled to a refund for that milestone. Completed and accepted milestones are not refundable.
- Currency: prices are shown in US dollars. Proposals for clients in other regions may be quoted in local currency; the currency and exchange rate used are stated in the proposal and fixed once it is accepted. Bank transfer fees charged by the sender's bank are the payer's responsibility.
4. Intellectual property
- Upon full payment, you own the final deliverables created specifically for your project (site code, design files, content created for you), unless otherwise agreed in writing.
- DevSeguro retains ownership of pre-existing tools, frameworks, internal methodologies, and generic/reusable components used to build your project.
- Security assessment reports are provided for your internal use; you may not redistribute or resell them without permission.
5. Client responsibilities
- Providing timely feedback, content, and access credentials needed to complete the project.
- Ensuring you have the legal right to any content, trademarks, or third-party materials you provide us to use.
- Maintaining your own backups and administrative access after project handoff, except where covered under an active maintenance plan.
6. Warranties and disclaimers
- We warrant that services will be performed with reasonable skill and care, consistent with industry standards.
- Except as expressly stated, services are provided "as is" without further warranties, including any implied warranty of fitness for a particular purpose.
- We do not guarantee specific business outcomes (traffic, sales, rankings) resulting from a website or application we build.
- We do not guarantee that any system will be entirely free of vulnerabilities following a security engagement — see Section 2.
7. Limitation of liability
To the extent permitted by law, DevSeguro's total liability arising from an engagement is limited to the fees paid for that engagement. We are not liable for indirect or consequential losses such as lost profit or lost business. Nothing in these terms limits liability that cannot be limited by law, including for fraud or wilful misconduct. Security assessments reduce risk but cannot guarantee that a website is free of vulnerabilities.
8. Maintenance & protection plans
- Monthly plans include the specific hours, scope, and site limits described on the Pricing page for the selected tier — work beyond that scope is billed separately or requires a plan upgrade.
- Plans renew monthly/annually as selected at signup.
- Cancellation terms: either party may cancel a plan with 30 days' written notice; fees already paid for the current period are not refunded.
9. Confidentiality
Both parties agree to keep confidential any non-public business, technical, or security information shared during the engagement, including vulnerability details discovered during a security assessment, except as required by law.
10. Termination
Either party may end an engagement in writing. If you end it, you pay for work completed up to that date, and we deliver the completed work and return or delete your data and access credentials on request. We may end an engagement if payment terms are not met or if the project would require unlawful activity.
11. Governing law
These terms are governed by the laws of Pakistan. We will always try to resolve disputes informally first; any dispute that cannot be settled that way is subject to the courts of Pakistan, unless mandatory consumer law in your country says otherwise.
12. Changes to these Terms
We may update these Terms periodically for the website and for future engagements; active project SOWs are governed by the terms in effect when that SOW was signed, unless both parties agree to a change.
